DMCA Policy

Xplorama respects the intellectual property rights of others and expects all users of our platform to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond promptly to valid takedown notices.

1. Our Commitment

Xplorama is committed to protecting the rights of copyright holders. We will remove or disable access to content that is found to be infringing upon proper notification. We also protect our own intellectual property and will issue takedown notices where our content is distributed without authorization.

2. How to Submit a DMCA Takedown Notice

If you believe that content available on xplorama.ca infringes your copyright, you may submit a DMCA takedown notice by emailing us at noreply@xplorama.ca with the subject line: DMCA Takedown Notice.

Your notice must include all of the following:

  • Description of the copyrighted work — identify the original work you claim has been infringed, with sufficient detail to locate it
  • URL of the infringing content — provide the specific URL(s) where the infringing material appears on our site
  • Your contact information — full name, mailing address, telephone number, and email address
  • Statement of good faith belief — a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • Statement of accuracy under penalty of perjury — a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf
  • Your electronic or physical signature

Incomplete notices may not be acted upon. False or misleading DMCA notices may expose the submitter to liability.

3. Our Response Process

Upon receipt of a complete and valid DMCA takedown notice, we will:

  • Review the notice within 72 hours of receipt
  • Promptly remove or disable access to the allegedly infringing content pending investigation
  • Notify the user who posted the content that it has been removed
  • Document the notice for our records

4. Counter-Notification Process

If you believe that content was removed in error or that you have the right to use the material, you may submit a counter-notification. Your counter-notification must include:

  • Your full name, address, telephone number, and email address
  • Identification of the content that was removed and its former location
  • A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification
  • A statement that you consent to the jurisdiction of the Federal Court for the district in which your address is located (or Manitoba, Canada if outside the U.S.) and that you will accept service of process from the complainant
  • Your electronic or physical signature

Upon receipt of a valid counter-notification, we will forward a copy to the original complainant and may restore the content within 10-14 business days unless the complainant files a court action.

5. Repeat Infringer Policy

Xplorama maintains a strict repeat infringer policy. In accordance with the DMCA, we will terminate the accounts of users who are repeat infringers. A user who receives three or more valid DMCA takedown notices will have their account permanently suspended.

6. Protecting Our Own Content

Xplorama actively monitors for unauthorized use of our digital files and content across the internet. We will issue DMCA takedown notices to platforms hosting our content without authorization, including:

  • File-sharing websites and torrent sites
  • 3D model marketplaces (Thingiverse, Printables, MyMiniFactory, etc.)
  • Social media platforms
  • E-commerce stores reselling our files
